The Governor of Illinois promulgated an emergency rule on April 13, 2020.
The rule creates a rebuttable presumption that front line workers who contract Covid 19 are entitled to Workers’ Compensation benefits.
This means that unless evidence establishes otherwise the front line worker who has Covid 19 is entitled to medical benefits, time off work pay, and potentially a payment for permanent partial disability benefits.
Illinois business groups are attacking the method of establishing the new rule.
This will most likely result in a law suit challenging the authority to issue the rule.
