Someone once asked me if Social Security conducts surveillance on people who apply for Social Security Disability.

I think it is very rare for this to happen.

There are just too many people who file for disability, and the Federal Government does not have enough money to chase after people.

However, if someone is receiving Social Security Disability or SSI and the Government receives a tip that they are committing fraud, then I think the Government is very aggressive in investigating it.

This is a criminal violation and you are subject to imprisonment if convicted.

Social Security employees also take it seriously when someone contacts them and reports that they think a person is not really disabled at the application stage.

I have seen Workers’ Compensation settlements blow up quickly over surveillance videos.

In Illinois, for purposes of Workers Compensation, it is legal to follow someone and video tape them without their permission.

Insurance Companies will hire private investigators to video tape injured workers.

They attempt to show that a person is going beyond their restrictions, or is not has injured as it appears.

Most people do not need to worry. However, it is important to be aware that you may be on candid camera.

Most videos do not show anything of value.

However, I have seen videos of a person dancing who supposedly had a severe back injury, or roofing a house with a shoulder injury.

Social Security Disability and Medical Treatment


It may seem obvious, but the most important part of getting approved for Social Security Disability is your medical treatment.

If you do not get treatment you will be denied.

The Administrative Law Judge looks at your medical records when they decide your case.

If you have no treatment or not much treatment you will lose your Social Security Disability case.

I realize it is often very difficult to get medical treatment without health insurance but there are ways to get needed treatment.

You can apply for a state medical card.

You can apply for charity care through local hospitals.

You can apply for free or reduced price clinics.

You can go to community mental health clinics.

Again, none of this is easy. However, you must try very hard to get the needed medical treatment.

It is worth it in the end, when you are found disabled.

What if Work Comp Denies Treatment?


If the Workers’ Compensation Insurance Company denies your treatment that the doctor is recommending, you have several choices.

Give up.

Have your group health insurance pay for the treatments.

Or fight the Work Comp insurance company.

To fight the Work Comp company you will need to file for a hearing, and have your doctor testify in favor of your treatment.

This will force the insurance company to send you to their doctor and hire a lawyer.

The more you show your willingness to fight the Work Comp insurance company the better your chances.
