Work Comp Hot Issues
Here are some big issues that occur in Illinois Workers’ Compensation Cases:
History of injury in the medical records. If you do not mention your work accident to the hospital or doctor, then you have an uphill battle.
Surveillance videos. Private investigation tapes of you working in the yard or on the golf course. Not always pretty.
Spotty medical treatment. The insurance company will try to nail you for long periods without treatment.
Not doing a strong job search. This will drop your case value quickly.
Combative witness. Fighting with the opposing attorney, and being surly before the judge will not help you.

Social Security Disability Hot Spots
The biggest problem areas I have seen recently in Social Security Hearings:
Unemployment benefits. Some judges believe it is inconsistent to get unemployment and ask for Social Security Disability.
Drugs and Alcohol. Big time problems if you cannot show treatment.
Following a Diabetic diet. Do you have diabetes? Are you compliant? Do you eat right. Some judges are starting to ask these questions.
Travel a lot? Seems to imply that you are not disabled if you can drive or fly long distances.
Babysitting. Some judges treat this like a job, even if it is for family on a sporadic basis.
