This case probably would have turned out the same in Illinois. You must show increased risk of the injury due to your work place to win the case in Illinois. If she was shot during a robbery at work she would win her case.

There has not much activism on the part of Illinois courts in Workers’ Compensation cases. The judges have been interpreting the law as the legislature wrote it. The real complaint the business community has is that it is unable to change the law as drastically as they think it should be. They have failed politically so now they are trying to influence the judicial branch.

Overpayments are clearly a nightmare. You are allowed to have trial work periods and to work part-time if you keep your wages under the limits allowed by law. You must also report your earnings to Social Security.
