An injured worker can sue her employer for a  workplace injury and the rig maker. The worker must prove the rig maker was negligent to win this part of the case. In addition, the work comp insurance company has a lien against any recovery from the rig maker. Why the Governor of Illinois Matters

The person who is elected as Governor of the State of Illinois makes a large difference in Workers’ Compensation cases.

The reason is that the Governor appoints Arbitrators who are judges over all work injury cases in Illinois.

The Governor also appoints Commissioners who act as Appeals Court Judges for workers’ compensation cases.

The Governor sets the tone for what Workers’ Compensation should look like in Illinois.

The current Governor makes it clear that he does not like injured workers and the payment of money for injuries and medical bills.

This opinion is clear to all who want to be an Arbitrator and Commissioner.

You will not see liberal Arbitrators and Commissioners under this Governor because they want to keep their jobs.

Injured workers need to be aware of this dynamic.

It may mean that you want to settle your case to get sure money, rather than risk going before an Arbitrator who will deny your claim or award you a low amount of money.

Beware the Obama Disability Scam

I have had several clients ask me about something they came across on the internet or had someone call them and solicit for Obama disability.

This appears to happen when someone signs up for Social Security Disability.

There is no such thing as Obama disability.

The only disability programs available through the Federal government are Social Security Disability and SSI.

Do not talk to anyone who claims to be able to get you money while you wait for application to be processed.

You should also not speak to anyone who solicits you after you have contacted Social Security.

The government is not in any way involved in connecting you with a lawyer or a representative to help you get disability.

You should be the person who seeks the lawyer not the other way around.

If someone contacts you, then you do not know who they are and why they are contacting you.

Do not give them any personal information such as your date of birth, social security number or address.

These appear to be sophisticated scam operations targeting people who are seeking Social Security Disability.

If you have any doubts about people who contact you, then call your local Social Security office or local law enforcement.
