Why Isn’t the At Fault Driver’s Insurance Company Paying My Medical Bills?

You have been injured in a motor vehicle collision and the other driver was clearly at fault.

The driver’s insurance company refuses to pay for your related medical bills.

What is going on?

The law does not mandate that the insurance company pay the bills while medical treatment continues.

At the completion of medical treatment the insurance company will have to pay for the bills and settle the case or face a lawsuit.

There are several ways to get the bills paid while you are waiting.

Seek payment through your group health insurance.

At the end of the case the auto insurance company will have to repay your group health insurance.

Seek payment from your medical payment coverage. Most insurance policies have money to pay for medical bills that can be used immediately.

At the end of the case the auto insurance company will have to repay your medical payment coverage.

Your challenge will be to get the medical treatment paid without waiting.

There are ways to do this. You must understand what each choice involves.

When you settle your case or receive your trial award you must pay your medical bills from the lump sum.

You may be able to reduce the medical bills after negotiating with medical providers.

This will help put more money in your pocket.

Raises some interesting legal issues. Someone is allowed to sue another person who sexually molests them. However, the law puts time limits on when a lawsuit can be filed. The idea is that it becomes difficult to obtain evidence after a certain length of time. This lawsuit appears to not actually be based on damages from the original sexual abuse, rather it is based on failure to live up to an agreement to pay money for the underlying abuse. Hastert is being sued for breach of contract. He may raise the defense of whether it is legal to contract for bribe money. Certainly, there is no sympathy for his actions. How the law addresses this will worth watching.
