Covid 19 and the Workplace

Illinois Workers’ Compensation law requires you to prove that it more likely than not that your work injury or disease resulted from the work place or work responsibilities.

We are learning more regarding Covid 19 everyday.

Proving a workplace exposure will most likely require expert medical testimony explaining how the exposed worker contracted the coronavirus and the resulting course of the disease.

Healthcare workers, grocery store and retail employees, nursing home workers, and people with high contact with the public will present the most straightforward cases.

Initially, it was thought people with coronavirus work exposure cases would have low value because of a quick medical recovery with limited permanent damages. However, there are reports of serious permanent damages for some people. Such as chronic kidney damage, severe breathing disorders, restrictions in walking and use of the arms, and death.

If you know of someone who has contracted Covid 19 on the job make sure to contact a Workers’ Compensation lawyer. Feel free to contact Illinois Workers’ Compensation Attorney Dirk May at 309-827-4371 to discuss your potential case.

Illinois Work Comp Settlements still being Paid

Many government agencies and companies are shut down and money is tight.

The good news is that in Illinois, insurance companies are still paying out settlement money for work injuries.

Make sure that the insurance company does not tell you that they cannot pay you a settlement, or that you have no money coming for your work injury.

At a time when money is tight some insurance companies will “forget” to pay you.

Illinois Work Comp Covid 19 rule Withdrawn

The recent Work Comp emergency rule promulgated to protect front line workers in Illinois who contract Covid 19 was the subject of recent lawsuit.

Business groups attacked the Governor’s authority to file the emergency rule.

The Illinois Workers’ Compensation Commission withdrew the rule.

The Commission announced it is working with business groups and attorneys representing injured workers to come up with a compromise solution to protect workers who end up with Covid 19.

Stay tuned for further development.

Illinois Business Groups Attack New Covid 19 Rule

The Governor of Illinois promulgated an emergency rule on April 13, 2020.

The rule creates a rebuttable presumption that front line workers who contract Covid 19 are entitled to Workers’ Compensation benefits.

This means that unless evidence establishes otherwise the front line worker who has Covid 19 is entitled to medical benefits, time off work pay, and potentially a payment for permanent partial disability benefits.

Illinois business groups are attacking the method of establishing the new rule.

This will most likely result in a law suit challenging the authority to issue the rule.
