Illinois Work Comp Settlements still being Paid

Many government agencies and companies are shut down and money is tight.

Illinois Work Comp Covid 19 rule Withdrawn

The recent Work Comp emergency rule promulgated to protect front line workers in Illinois who contract Covid 19 was the subject of recent lawsuit.

Business groups attacked the Governor’s authority to file the emergency rule.

The Illinois Workers’ Compensation Commission withdrew the rule.

The Commission announced it is working with business groups and attorneys representing injured workers to come up with a compromise solution to protect workers who end up with Covid 19.

Illinois Work Comp Court Reopens in May

There have been no Workers’ Compensation trials or court dockets since the middle of March 2020 due to the coronavirus.

The Illinois Workers’ Compensation Commission has issued a memo indicating that starting in May 2020 the court will be open in a limited fashion.

Trials may be requested in May and held in June 2020.

There will be a limited number of trials and both sides must agree to the trial.

It is not perfect, however it does move a step closer to reopening fully.

The Illinois Workers’ Compensation system does continue to settle cases and accepts new filings.

Many courts and agencies in Illinois are closed due to the coronavirus.

Illinois Business Groups Attack New Covid 19 Rule

The Governor of Illinois promulgated an emergency rule on April 13, 2020.

The rule creates a rebuttable presumption that front line workers who contract Covid 19 are entitled to Workers’ Compensation benefits.

This means that unless evidence establishes otherwise the front line worker who has Covid 19 is entitled to medical benefits, time off work pay, and potentially a payment for permanent partial disability benefits.

Illinois business groups are attacking the method of establishing the new rule.

This will most likely result in a law suit challenging the authority to issue the rule.
