What you tell your doctor regarding your injuries and disability is very important to your work injury and Social Security cases.
It must be found in the medical records or the Judge and Arbitrator will ignore you and it will possibly cause you to lose your case.
For instance, make sure to tell your doctor at each visit the following:
what body parts are bothering you;
the level of your pain at each visit;
your limitations, such as it is difficult to walk, reach, handle and finger, lift, sit, stand;
unusual conditions such as swelling, numbness, or problems concentrating;
what you must do to address your pain and problems, such as elevate your legs, use a cane, use heat and ice;
ask for a prescription for a cane if necessary, or a disability parking permit (make a copy for yourself of any prescriptions or papers);
tell the doctor if you are having any medication side effects involving fatigue, sleepiness, concentration and focus issues.
Following these steps will make your medical records more complete and support your testimony at your trial.

In Illinois, the Workers’ Compensation Law bases awards and settlements on your wage.
Here is a quick example.
An McDonald’s employee injures his back and has the same surgery as a union worker at a manufacturing plant.
Both injured workers settle for 20 percent of the person. This means 100 weeks of benefits.
Assume the McDonald’s worker earns $10 per hour for 40 hours of work per week. $400 average weekly wage.
Assume the union worker earns $30 per hour for 40 hours of work per week. $1200 average weekly wage.
The law provides the injured worker is entitled to 60 percent of the average weekly wage.
McDonald’s worker $400 times .6= $240 times 100 weeks of benefits= $24,000
Union worker $1200 times .6= $720 times 100 weeks of benefits= $72,000
Big difference in settlement with the same injury and surgery.
