You Need to be Genuine and Believable before the Judge

Dirk May Social Security Disability, Workers Compensation October 3, 2022October 3, 2022Bloomington IL Social Security Disability Lawyer, Bloomington IL Workers' Compensation Attorney, Bloomington IL Workers' Compensation Lawyer

No matter the type of case you have in Illinois, whether it is a Workers’ Compensation claim, Social Security Disability case, or a personal injury case you need to be believable.

It is important that your testimony is consistent with your medical treatment records.

Your records contain a history of what you tell your doctor each time you receive treatment.

You will need to explain your pain and how it impacts your daily activities.

The Judge also wants to know how your condition permanently limits you.

Even a person with severe conditions can usually do some housework or limited activities. It is important that you can explain how long you can function before you need to take a break.

Being genuine includes having a good work history, explaining clearly the effects of your injury, and how you are limited on a daily basis.

Retired. Can I get Social Security Disability?

Dirk May Social Security Disability August 22, 2019August 22, 2019Bloomington IL Social Security Disability Lawyer, Bloomington Illinois Social Security Disability Attorney

What if you are receiving Social Security retirement, are you able to file for Social Security Disability?

You may still be able to take advantage of SSDI (Social Security Disability) benefits.

You will have to prove that you are disabled before your full retirement age (which currently varies from age 66 to 67).

The advantage of Social Security Disability is that the payments are higher than retirement benefits because you are treated as being full retirement age.

For instance, someone who retires at age 62 and takes Social Security benefits usually will make several hundred dollars less per month than a person who receives SSDI benefits.

You must prove you meet the disability requirements at the time you stopped working. This means the inability to continuing working at your former job and limitations to sedentary or light work.

It is certainly worth discussing with a Social Security Attorney.

A Social Security lawyer is only paid if the lawyer wins your case and gets you benefits.

Filing for Social Security Disability and Workers’ Compensation

Dirk May Help July 19, 2018July 19, 2018Bloomington IL Social Security Disability Lawyer, Bloomington IL Work Comp Attorney, Bloomington IL Work Comp Lawyer, Bloomington Illinois Social Security Disability Attorney

When should you file for Social Security Disability or your Work injury case?

You should file for your Workers’ Compensation case right away.

This will put your employer on notice and they will not be able to argue that they did not have timely notice of the injury.

It also gets your time off work pay and medical benefits going.

Tell your doctors and other medical providers that you have filed for a work injury case so that all the records and bills will go to the work comp insurance company.

There is no good reason for delaying in filing the application of claim.

Talk to an experienced Illinois Workers’ Compensation Attorney to learn how to file an application of claim.

No fee is charged until you recover.

You may file for Social Security Disability as soon as you stop working full time.

If you delay it may reduce the benefits you receive from Social Security.

The filing process is done online.

This notifies Social Security that you have stopped working and are seeking the benefits you are entitled to under the law.

It also tells Social Security that they need to get all the medical records from all your providers.

An experienced Social Security Disability Attorney will help you file online.

No fee is charged until you recover back benefits.

Doctor Visits for Your Work Injuries and Disability

Dirk May Law May 24, 2018May 24, 2018Bloomington IL Social Security Disability Lawyer, Bloomington Illinois Social Security Disability Attorney, Bloomington Illinois Work Injury Attorney, Bloomington Illinois Work Injury Lawyer

What you tell your doctor regarding your injuries and disability is very important to your work injury and Social Security cases.

It must be found in the medical records or the Judge and Arbitrator will ignore you and it will possibly cause you to lose your case.

For instance, make sure to tell your doctor at each visit the following:

what body parts are bothering you;

the level of your pain at each visit;

your limitations, such as it is difficult to walk, reach, handle and finger, lift, sit, stand;

unusual conditions such as swelling, numbness, or problems concentrating;

what you must do to address your pain and problems, such as elevate your legs, use a cane, use heat and ice;

ask for a prescription for a cane if necessary, or a disability parking permit (make a copy for yourself of any prescriptions or papers);

tell the doctor if you are having any medication side effects involving fatigue, sleepiness, concentration and focus issues.

Following these steps will make your medical records more complete and support your testimony at your trial.

I have seen many people testify in Social Security Disability, injury cases, and Work Comp cases.

It is a nerve wracking experience for most people.

Here is the best way to approach this important moment for you and your case.

Remember that the Judge is a person just like you are.

You are inclined to help someone who is polite, nice and honest.

Make it easy for the Judge to want to help you.

So be sure to be early for your hearing.

Wear clean clothes. They do not have to be fancy but be presentable.

Answer questions in a believable and friendly way. Do not fight or argue with the Judge.

Give the Judge a picture of how your daily activities are impacted as a result of your injury.

You can do certain things, however be ready to explain your limitations and how your condition has changed you since the injury.

Remember if give the Judge all the reasons to like you the trial will go much smoother for you.
